Value Exchange Agreement

1. Definitions

1.1 Hashed Rights

"Hashed Rights" means the cryptographic proof package generated by our service, consisting of:

• A SHA-256 hash of your creative work or its representation
• A timestamp proving when the hash was created
• A digital signature authenticating the proof
• Your unique Creator Crest linking the proof to your identity

1.2 What Hashed Rights Are NOT

• Copyright registration (we don't replace the Copyright Office)
• Legal advice or representation
• A guarantee of ownership or legal protection
• Government-recognized intellectual property registration

Hashed Rights are evidence - proof that you claimed creation of something at a specific time. They support your case; they don't make it automatically.

2. The Value Exchange

2.1 What You Give Us

• Creation Metadata: Descriptions, titles, timestamps of your creative work
• Hash Data: Cryptographic fingerprints of your files (we don't store your actual files unless you choose snapshot features)
• Activity Logs: Your creation timeline, proving the human process behind your work
• Identity Information: Name, email, and company for your Creator Crest

2.2 What You Get From Us

• Cryptographic Proof: Timestamped, signed evidence of your creation claims
• Creator Crest: Your unique visual identifier linking all your hashed rights
• Evidence Trail: A permanent, verifiable record of your creative process
• Export Packages: PDF documents and hash files for external verification
• Priority Establishment: "First to claim" evidence for disputes

3. Your Commitments

3.1 Authenticity

You agree that:

• You will only hash work that you actually created or have rights to claim
• You will not submit false or misleading creation claims
• You understand that fraudulent hashing does not create legitimate rights
• You accept responsibility for the accuracy of your submissions

3.2 Lawful Use

You will not use Hasht to:

• Hash stolen, plagiarized, or infringing content
• Create false evidence of creation
• Harass, threaten, or defraud others
• Violate any applicable laws or regulations

5. Evidence & Retention

5.1 Permanence is a Feature

Your hashed rights are designed to be permanent evidence. This means:

• We retain your proof data indefinitely to preserve its evidentiary value
• Deletion of proofs may not be possible once created (evidence must persist)
• Your Creator Crest and associated claims remain in our system
• This permanence IS the value - evidence that can be deleted isn't evidence

5.2 Account Termination

If you close your account:

• Your access to the dashboard ends
• Your existing hashed rights remain valid and verifiable
• We retain proof data for evidence integrity
• You may request export of your data before closure

6. Disclaimers & Limitations

6.1 No Legal Guarantees

Hasht provides evidence tools, not legal outcomes. We do not guarantee:

• That your hashed rights will be accepted in any legal proceeding
• That you will win any dispute based on our proofs
• That our service replaces proper legal advice or registration
• Specific outcomes in intellectual property matters

6.2 Service Availability

We strive for high availability but cannot guarantee uninterrupted service. We are not liable for:

• Temporary service outages
• Data loss due to circumstances beyond our control
• Third-party service failures

7. Intellectual Property

You retain all rights to your creative work. By using Hasht, you grant us a limited license to:

• Store and process your metadata and hashes
• Generate cryptographic proofs on your behalf
• Display your Creator Crest in connection with your account
• Maintain evidence records as part of our service

We claim no ownership of your creative work. The hash is not the work - it's proof of the work.

8. Governing Law

This agreement is governed by the laws of the United States. Any disputes will be resolved through binding arbitration, except where prohibited by law.

9. Changes to Terms

We may update these terms. Material changes will be communicated via email or dashboard notification. Continued use after changes constitutes acceptance.
